What is an Appeal?
You may be wondering what a legal appeal entails. Simply put, an appeal can happen when a lost legal case is taken to the higher (appellate) court for further evaluation, because the decision is not agreed upon by the losing party.
How Does the Appellate Process Work?
The appellate process allows you to argue that the lower court made a legal error when it decided your case. For example, the lower court may have misinterpreted the law, made an error when it admitted or excluded evidence, or made a mistake in its instructions to the jury.
If you can show that the lower court made such an error, you may be able to get the decision reversed or overturned on appeal.
Winning an appeal is a complicated process. The standard of review that the appellate court uses will determine how difficult it will be to persuade the appellate court to reverse the decision of the lower court.
The process that the appellate court uses includes:

- Or abuse of discretion review
